Former Sacco Managers Charged in Sh40 Million Fraud Scheme

 

Three former officials from the Afya Sacco Society Limited were arraigned at the Milimani Law Courts, facing charges of conspiring to defraud the cooperative of over Sh40 million. The alleged fraud involved fraudulent deposits and withdrawals executed over a four-year period.

The three suspects—Evans Mung’ahu Kola, Fredrick Kuya Libako, and Mumina Mutinda Ingu’i—appeared before Milimani Chief Magistrate Lucas Onyina. They faced multiple counts related to fraud, theft, and money laundering.

According to the charge sheet filed by the Office of the Director of Public Prosecutions (ODPP), the trio is accused of conspiring to defraud Afya Sacco Society Ltd of Sh40,169,165.69. The offenses reportedly took place between April 20, 2021, and January 31, 2025.

Prosecutors allege that the accused, working with an individual not present in court, created fraudulent deposits and withdrawals through Front Office Service Activity (FOSA) accounts. They falsely represented these transactions as genuine, resulting in massive financial losses for the Sacco.

  • Evans Mung’ahu Kola:A former Manager of Afya Micro Credit Activities (AMCA), Kola is accused of stealing the entire Sh40.1 million, which allegedly came into his possession by virtue of his employment.
  • Fredrick Kuya Libako:Libako faces an additional charge of stealing contrary to Section 268 and Section 275 of the Penal Code. Prosecutors claim he and the others jointly stole the funds through the Sacco’s FOSA accounts.

All accused persons were charged under the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA) for acquiring and using the proceeds of crime.

Court Ruling
The accused pleaded not guilty to their respective counts. The court granted each accused person a bond of Sh4 million or an alternative cash bail of Sh2 million, with one surety of a similar amount.
